Terms of service.

These Terms of Service ("Terms") govern your use of HomePro AI Command and all related services operated by Elianatech LLC ("HomePro AI", "we", "us"). By creating an account or using the service, you agree to these Terms.

1. Account

You must be at least 18 and authorized to enter contracts on behalf of your business. You're responsible for maintaining the security of your account credentials. Notify us immediately of any unauthorized access.

2. Subscription, Payment, and Cancellation

2.1 Pricing

Pricing is communicated in writing during the sales process and confirmed in your Master Services Agreement. Setup fees are one-time. Monthly retainer is recurring. Platform fees, where applicable, are billed monthly against transactional volume as defined in your MSA.

2.2 Payment

Setup fee is due before installation begins (or per the approved payment plan). Monthly retainer auto-bills on the same day each month. Platform fees calculated and billed monthly.

2.3 60-Day Guarantee

Every installation includes a 60-day first-result guarantee. If Command doesn't produce a measurable first result within 60 days of go-live, we continue building, configuring, and improving at no additional cost until it does. This is a service commitment - not a refund policy.

2.4 Cancellation

Monthly retainer is month-to-month after setup. Cancel with 30 days' notice. Setup fees are non-refundable except where required by law. Upon cancellation, you receive a full data export.

3. Acceptable Use

You agree not to use Command to:

• Send spam, fraudulent, or deceptive communications
• Violate any law, regulation, or third-party right
• Reverse-engineer or attempt to access source code
• Resell access to Command without a white-label agreement
• Use the AI components to generate content that violates our usage policies

4. Your Data

You own your data. We're a processor, not the controller. You decide what goes in, what comes out, and where it's shared. You grant us only the rights needed to operate Command on your behalf.

5. Our IP

Command - the software, AI models, brand, documentation - is owned by Elianatech LLC. We grant you a non-exclusive, non-transferable license to use it while your subscription is active.

6. Service Levels

• Uptime: 99.9% SLA for paid tiers (excluding scheduled maintenance announced 48hr in advance)
• Support: Foundation = email + chat · Operations = 4hr SLA · Command = named contact + same-day SLA
• Backups: 4× daily snapshots · 30-day retention · disaster-recovery RTO under 4 hours

7. Warranties + Disclaimers

We provide Command "as is." We don't warrant that AI outputs are perfect - Command is a tool, not a replacement for your professional judgment. You're responsible for reviewing AI-generated estimates, communications, and decisions before they affect customers or finances.

8. Limitation of Liability

To the maximum extent permitted by law, Elianatech LLC's total liability arising from these Terms or your use of Command is limited to the fees you paid us in the 12 months preceding the claim. We're not liable for indirect or consequential damages.

9. Indemnification

You agree to indemnify us against claims arising from your use of Command, your violation of these Terms, or your violation of any law or third-party right.

10. Dispute Resolution

These Terms are governed by Florida law. Disputes are resolved by binding arbitration in Tampa, Florida - except for small claims, IP claims, and emergency injunctive relief.

11. Changes

We may update these Terms. Material changes are emailed to active users at least 30 days before they take effect. Continued use after the effective date means you accept the updated Terms.
